Lawyers expect a certification hearing in class proceedings against Visa and Mastercard no later than early 2023. Class action against Mastercard and Visa filed with the UK’s Competition Appeal Tribunal (CAT) in June by London-based litigation firm Harcus Parker is expected to appear before the CAT for a certification hearing in late 2022 or early 2023, according to partners Jeremy Robinson and Tom Ross. Certification is the gateway for class actions to be allowed to proceed to trial. Unlike the high-profile case Merricks v Mastercard, which focuses on alleged harm to UK consumers, Harcus Parker’s claim concerns fees charged to businesses – ‘merchants’ – for accepting corporate cards or personal cards issued in a territory other than that in which the merchant is based.
